Information note regarding the processing of personal data

Guidance for using the online service for releasing information from the Central register of beneficial owners

Application-form for releasing information on the beneficial owners

 

NOTE:

  • the access to the Register of beneficial owners (RBO) is ensured, in compliance with the regulations on the protection of personal data, to any natural or legal person under the condition of online registration and the payment of an administrative charge, based on a request for access, being necessary a qualified electronic signature, in compliance with the dispositions of the Law no. 455/2001 on the electronic signature, as republished - details

 

  • from the Register of beneficial owners, there are released two types of information, namely:
    • information on the beneficial owners of a legal person (up to date status);
    • release of an historical report on the beneficial owners of a legal person/the quality of beneficial owner of a natural person;

 

  • the administrative charge for the access of the natural or legal persons to the Register of beneficial owners is established in compliance with the Order of the minister of justice no. 7323/C/2020 for the approval of the Procedure regarding the online registration and for the approval of the charges for the access to the Register of beneficial owners kept by the National Trade Register Office - details;

 

  • the procedure for online registration for the access to the Register of beneficial owners kept by the National Trade Register Office is also applied to the authorities which have the competency to supervise and control, to the judicial bodies, to the National Office for Prevention and Money Laundering and to the reporting entities, if they choose this way of access to the Register of beneficial owners, based on a document signed electronically by the legal representative. The access is ensured, in compliance with the regulations on the personal data protection, free of charge, without any restriction and without alerting the person in question, and in case of reporting entities, when they apply the measures for knowing the clientele.
  • for the reporting entities and for the natural or legal persons, the release of information from the Register of beneficial owners, issued online through the services portal of NTRO, shall contain: the last name and the first name, the month and the year of birth, the nationality and the residence country of the beneficial owner, as well as the information on the nature and magnitude of the owned interest generating benefits;

 

  • information on the quality of beneficial owner of a natural person within one or more Romanian legal persons may be obtained by filling in the application-form no. 15A - Cerere furnizare informații beneficiari reali (Application for releasing information on the beneficial owners), checked to point 2, item 2.1 (available exclusively online, by accessing the services portal portal.onrc.ro, section Servicii online RBR (RBO online services), item Cerere furnizare informații din RBR (Application for releasing information from RBO) and its sending to the e-mail address beneficiarireali@onrc.ro. The application-form shall be signed with qualified electronic signature, in compliance with the dispositions of the Law no. 455/2001 on the electronic signature, as republished. Afterwards, whereas the case, the calculation note shall be communicated from the e-mail address beneficiarireali@onrc.ro to the e-mail address from which the request was received, and the applicant shall have to transmit on the same e-mail address the evidence of making the payment;
  • the reporting entities may request for the release of information from the Register of beneficial owners which may contain personal data only if the application is submitted to the counter or it is sent by correspondence (post, courier, e-mail), when the measures of knowing the clientele are applied - details;

 

  • the deadline for releasing the requested information through applications submitted upon the counter or sent by correspondence (post, courier, e-mail) shall be settled within 5 working-days since their registration (in case irregularities are found or there are requested documents in completion, the deadline of 5 days starts from the date of their correction).
