Information note regarding the processing of personal data 

Application-form for releasing documents from the register of beneficial owners (RBO)

Note

1. Copies of the declaration of beneficial owners are released to the authorities which have the competency of supervising and control, to the judicial bodies, under the Law no. 135/2010 on the Criminal procedure code, as subsequently amended and supplemented and to the National Office for Prevention and Combating Money Laundering (ONPCSB), free of charge, in due time, without any restriction and without alerting the person in question.
2. Under the ground of art. 15 paragraph (3) of the Regulation no. 679/2016 on the protection of natural persons with regards to personal data processing and on the free movement of such data and for the abolishment of the Directive 95/46/EC (General data protection regulation), upon the request of the data subject (the person whose data are processed), the operator releases a copy of the personal data which are the subject of the process. 
   Therefore, as for the copies of the declaration on the beneficial owners, there are released only simple copies to the data subject/s, by respecting the following:
   ➢  In case the requester of the application is the bearer of the declaration on own responsibility (natural person - legal representative of the legal person), this have the right to obtain a copy of the declaration on own responsibility on the beneficial owners, including from its annex, in the submitted form, grounded on the dispositions of art. 15 paragraph (3) of the Regulation (EU) no. 679/2016.
   ➢ In case the requester of the application is one of the declared beneficial owners, he shall receive a copy of the declaration on own responsibility on the beneficial owners (including of the annex where he is specified, in case of the submission of the application - form), containing only the personal data of the applicant (the personal data of the other natural persons declared as beneficial owners and of the bearer of the declaration on own responsibility shall be anonymized).
   ➢ The charge for releasing copies for the data subjects is the one specified by the Order of the minister of justice no. 1788/C/2011 on the approval of the charges for the auxiliary services carried out by the trade register offices attached to the law courts and by the National Trade Register Office, namely 0,40 lei without VAT/multiplying documents, format A4 1 page, or 0,56 lei without TVA/multiplying documents, format A4 both sides.
3. The deadline for the settlement of the applications having as object the release of copies of the declarations on the beneficial owners is of maximum 15 calendar days from the date of registration of the application/address on within the deadline specified by the requesting authority.
4. The application for requesting copies filled in as appropriate by the requester to the trade register office attached to the law court, directly to the counter or sent by post/courier, with letter with declared value and notice of receipt or by electronic means.
5. The application for requesting copies shall be accompanied, as appropriate, by a special mandate (in authenticated form), a power of attorney for the persons appointed to fulfill the legal the legal formalities (original), and after its submission, also by the evidence of paying the charge requested for the application, specified in the calculation note drawn up by the trade register office attached by the law court.
6. The application sent in electronic form by e-mail shall have incorporated, attached or logically associated the qualified electronic signature.  
7. In case the documents are sent by post, the identity card of the requester shall be attached, as holograph photocopy certified by the bearer regarding the compliance with the original.
