Documents required for correction of material errors found in the registrations in the trade register

Information note on the processing of personal data

I. The correction of material errors can be requested in the following situations:

  • In case of detecting material errors in the applications for incorporation/registration or within the documents submitted to the trade register office attached to the law courts;
  • In case of detecting material errors in the certificates of incorporation/certificates of status for authorization/ certificates of amendments’ registration*;
  • In case of errors in the resolutions of the director of the trade register office attached to the law court*;
  • In case of errors from the data base*;

 

Registration

  1. Application for correction of material errors for natural persons - application form or for legal persons - application form  found in the trade register for the amendments laid down above shall be accompanied by:
  2. Proving documents of the error/rectifying document;
  3. Where appropriate:
    • certificate of incorporation/certificate of status for authorization/certificate of amendments’ registration;
    • prior endorsements provided for by special laws (original);
    • (special) power of attorney (in authenticated form) or delegation for the persons appointed to fulfil the legal formalities (original);
  4. Evidence of payment of legal charge - details:

 

In case the material error from the data base/resolution of the director of the trade register office attached to the law court or from the certificate of incorporation/certificate of status for authorization/certificate of amendments’ registration comes from an incorrect takeover of the data from the application for incorporation/registration or from  the documents submitted in support of it, the correction shall be done ex officio, free of charge, and the petition to the trade register office attached to the law court can be done by simple application, submitted by the register office.

  1. The application for registration, the documents provided for by law, filed and numbered, shall be submitted by the applicant directly at the trade register office attached to the law court, by post, with declared-value letter and notice of receipt or by electronic means. The application sent in electronic form, through the online services portal or through the electronic mail, shall have the qualified electronic signature incorporated, attached or logically associated. If the documents are sent by post, the applicant's identity document shall be attached, as a handwritten photocopy  certified by the owner regarding the conformity with the original.
  2. The documents whose registration, change or publication is requested at the trade register office attached to the law court shall be drawn up by the applicant in Romanian, shall be legible, without deletions or additions, under the sanction of rejection thereof.
