After 40 years of absence, the trade register reappears in the Romanian economic environment, being set up based on Law no. 26/1990, republished as subsequently amended and supplemented, as a specific institution of the market economy.
Structure and organisation
The Trade Register is structured and organized at two levels:

at local level, represented by 42 territorial offices, under the subordination of the National Trade Register Office, operating as attached to each county Law Court
-
at national level, represented by the National Trade Register Office functioning under the subordination of the Ministry of Justice
Short history
The first records on businesses are mentioned during The Middle Ages, when labour associations kept data on traders and craftsmen. After the union of the Romanian principalities and once the Romanian modern state is founded, by new laws and amendments, an increased importance is given to keeping evidence of the structure and activity of the firms:
1864 - The first law on the organization of the Chambers of Commerce and Industry is voted and promulgated.
1868 - The existing law is amended and contains the germ of the trade register office. Article 3 of the bill stipulates that no registration may be made at the Law Court prior to registration in the registry of the Chamber of Commerce and Industry in the district.
1884 - The "Law on firm registration" is promulgated whereby the records of trading companies are organized in a modern way.
1913 - New amendments concerning the structure of the trade register are implemented by the "Regulation on the form and manner of keeping registers for company registration", as approved by royal decree.
1931 - The trade register is organized as attached to the Chamber of Commerce and Industry. The new "Law on the set up of a trade register", published in the Official Gazette no. 84 of 3 April, stipulates that each Chamber of Commerce and Industry should, through a specific office and under the control of a delegated judge, keep a trade register for registration of the deeds whose publicity was required by the law. Incorporations and changes are published in the "Bulletin of the Chamber of Commerce and Industry".
1945 - At the end of this year, 157,626 companies were registered, out of which 147,038 individual firms and 10,588 social firms.
1950 - The trade register is dissolved, its functions being incompatible with the socialist economy.
1990 - Resuming the tradition of the Romanian economy during the inter-war period, the trade register is re-established as attached to the Chambers of Commerce and Industry in Romania, on 15 November, as a specific institution of the market economy, with objectives and functions set out by Law no. 26/1990 on the trade register and Law no. 31/1990 on trading companies.
2002 - The National Trade Register Office becomes a public institution with legal personality, entirely financed by in-house revenues, organized under the subordination of the Ministry of Justice, based on Emergency Government Ordinance no.129/10.10.2002 as approved by Law no. 505/2003. The territorial trade register offices are organized under the subordination of the National Trade Register Office and function as attached to each county Law Court.

on paper, containing the resolution of the director/designated person, the applications for registration and the traders’ documents
- methodological guidance of the trade register offices attached to law courts by elaborating unitary norms regarding how trade registers have to be kept and registrations performed
- elaborating the unitary norms regarding the internal organization and functioning of the trade register offices attached to law courts
- design/achieve, implement and maintain the unitary information system of the trade register
- statistical information
